Firing an employee for breach of company policy in Alberta
Some employers treat their company policies as if they were sacred texts. You fail to follow it and you are fired. Unfortunately, both HR and in-house counsel often buy into this narrative without considering whether these policies are legally enforceable.
Employment policies must be reasonable and before you fire an employee for a breach, you need to consider a host of factors about the employee’s personal circumstances.
Many large sophisticated institutions with legal counsel seem to get this wrong. I’m not sure how, unless it’s deliberate.
