Alberta Child Support Guidelines

In Alberta, there are two similar sets of guidelines that determine how child support payments are calculated:

The Federal Child Support Guidelines are part of the Divorce Act. These specific set of guidelines do not apply to unmarried parents or third parties seeking child support. In these instances, the Alberta Child Support Guidelines (under the Family Law Act) would help determine child support eligibility and payments. As mentioned earlier, these two acts are very similar in the requirements set forth to determine the needs of each unique family.

The following factors are considerations for both guidelines:

  1. Payor’s gross annual income
  2. Number of children in the household
  3. Special or add-on expenses

Although the intent of these guidelines is to establish fairness and reduce conflict between the parties involved, finalizing child support cases can become complicated.

In some instances, individuals will argue the payments required. Worse still, some will flat out resist supporting their families altogether. In these cases, the Maintenance Enforcement Program (MEP) can help collect court-ordered child support and enforce as needed.
