When an individual or group of unionized workers have a formal complaint against their employer, they must submit their grievance to their union first. The union then becomes the exclusive bargaining agent for the employee and has the duty to fairly represent them. They must do so in good faith, and cannot act arbitrarily or discriminatorily.
But what if your union is of no help to you? In Calgary, we see more of this than we should. Some union reps will sit back and do nothing with union members’ grievances. If this happens, we can assist you in making a complaint against your union to the Alberta Labour Relations Board or the Public Sector Labour Relations and Employment Board, whichever applies to you.
