Family Law Agreements that Work For You
Family law agreements help protect your interests, whether you are just entering into a formal relationship, during the course of a relationship or at the end of a relationship. These agreements help reduce stress and costs. We can help you draft a customized family law agreement that fits your family’s needs. Going forward, we also help negotiate the terms of such agreements. Common family law agreements include:
Cohabitation agreements are designed for couples who do not marry under the law, but are living together. We can draft agreements for you that determine entitlement and obligations, setting out the roles, rights and responsibilities of each partner in the relationship.
Prenuptial agreements are legally binding contracts for couples who are about to get married. In such agreements, it is imperative to predetermine rights and responsibilities and reduce uncertainties. We can assist you by making it clear who owns what when assets are divided. Our lawyers also will make sure the rights of your child/children are protected.
Postnuptial agreements are similar to prenuptial agreements. Our experience has identified that the difference lies in when the agreement is drafted and when it goes into effect. We can assist you in drafting a postnuptial agreement, which is also a binding contract.
Separation agreements are interim agreements made by separating couples, pending their decision to reconcile or divorce. Parties going through separation may enter into an agreement on issues involved in ending their relationship.
Emergency Protection Order (EPO)
An EPO is a type of restraining order against another member of a family when family violence occurs. Anybody can apply for an EPO. Whether you are a child, an adult or an elderly person feeling threatened, you can apply for an EPO from the provincial court. If violence and/or threatening behaviour leaves you feeling fearful, please contact us and we can guide you with your next steps.
Alternative Dispute Resolution (ADR)
We are a dedicated team and finding the right solution to your problem is one of the ways we execute our responsibility. Depending on the facts of your case, we may recommend ADR. Many family law issues can be solved through negotiation and mediation. Family mediation in Alberta is an interest-based process, which means that it encourages parties to communicate, negotiate and resolve problems out of court with the help of a dispute resolution officer (DRO).
